LEGAL BASES BLACK WEEK GIVEAWAY 2024

The commercial entity called TOSA, SARL (hereinafter, the “Organizer”), with registered office for these purposes at Carretera Alicante, 94, 03690 (San Vicente del Raspeig) and with CIF number LU31563238, registered in the Luxembourg Trade Register, has decided to carry out a promotional activity (hereinafter, the “Promotion”), consisting of holding a draw among users who meet the conditions explained below. All of this in accordance with the provisions of these legal bases (hereinafter, the “Bases”).

1.- SCOPE OF APPLICATION
The geographical scope of the Promotion extends to the entire national territory (with the exception of Ceuta and Melilla and the Canary Islands), and all those people, nationals or residents, who during the time period of the Promotion follow the established promotional mechanics and meet the requirements established in these Bases may participate.

Likewise, this Promotion will begin on November 25, 2024 and will end on December 1, 2024 (hereinafter, the “Time Scope”).

2.- PARTICIPATION REQUIREMENTS
Only natural persons of legal age who voluntarily follow the Instagram profile of the shopping center @theoutletstores and who comment mentioning two users in the publication thereof (hereinafter, the “Participants”) may participate in the Promotions. The 2 conditions are absolutely necessary for the user to be part of the draw.

Each user may participate only once in the draw, so duplicate comments will not count as participation in it.

Without prejudice to the foregoing, the following may not have the status of Participants or, therefore, be awarded:

The employees of TOSA, SARL and the employees of the stores located in the The Outlet Stores Alicante Shopping Center, even when they act with false, secret or third-party profiles; Employees of associated companies, advertising agencies or promotion agencies or other companies that are involved in any way in the Promotion.
The immediate family members (parents, siblings and children) of the persons included in point 1;
The spouses of all persons included in points 1 and 2;
Those persons who, at the sole discretion of the Organizer, are voluntarily or involuntarily harming the development of the Promotion; and
Participants who carry out acts or make comments in any medium that are unpleasant and are directed at the Promotion, other Participants, the Organizer, the Center, its employees or any of its collaborators.
All those Participants who access the Promotion with false, incorrect or incomplete profiles.
Participants who have been eliminated from this or any other Promotion carried out by TOSA, SARL, its subsidiaries, or any of its collaborating entities, whether national or foreign.
3.- COMMUNICATION
The Promotion may be communicated through the following means:

Insertions in the media in which the Company advertises.
Through the Facebook page/wall called “The Outlet Stores Alicante”.
Through the Instagram profile called @theoutletstores.
Through the personnel authorized by the Organizer for its communication.
Through any other means of dissemination that the Organizer considers of interest for the communication of the Promotion.

4.- PROMOTIONAL MECHANICS
All those who wish to participate in the Promotion must carry out the following steps:

Be a follower of the social profile of the shopping center on Instagram called @theoutletstores.
Comment on the publication of the draw mentioning two users.
Once these two actions have been carried out, the Participant will enter the draw.
The following will be drawn:
1 gift card valued at €50 to spend in the Fifty store at The Outlet Stores Alicante.
1 gift card worth €100 to spend at the Puma store at The Outlet Stores Alicante.
1 gift card worth €150 to spend at the Adidas store at The Outlet Stores Alicante.
1 Moulinex Easy Fry & Grill air fryer from our Home and Cook store.
1 Xiaomi Redmi Note 13 smartphone.
Once the draw has been resolved, on December 2, the lucky winner will be notified via Instagram by publishing the name of their social profile on the shopping center profile.
The lucky winner will have to send a private message to @theoutletstores to provide their personal details, which they will then present to collect the prize at The Outlet Stores Alicante facilities. The lucky winner has 7 calendar days from the publication of the winner to claim their prize via private message. The winner will have 15 calendar days to collect the prize at the management offices of The Outlet Stores Alicante. 5.- GENERAL ASPECTS OF THE PROMOTION

1) It is strictly prohibited for any of the Participants access the Promotion with more than one username. In this regard, any Participant who fails to comply with this essential rule of the Promotion will be automatically disqualified from these and future promotions, and will be deprived, if applicable, of the Prize that was awarded to them, and will be obliged to return it to the Organizer within fifteen (15) days from the request, by any means, to the Participant who was wrongfully awarded, with the latter bearing all costs and expenses that may arise from the return.
However, those Participants who can prove that there was a typographical error beyond their control will be exempt from the provisions of the previous paragraph.
2) The mere fact of participating in the Promotion will imply the acceptance of these Rules without reservation of any kind. 3) In the event that any of the Participants express their refusal to accept these Terms, or accept them in part, they will be excluded from these and future promotions, and the Organizer will be completely released from compliance with any obligations contracted with said Participant.
4) If the Participant makes a claim for any defect in the gift received, they will have 7 days from the delivery of the gift to notify and deliver it to the shopping center, which will then deliver another equal or similar gift as soon as they have stock.
5) The Organizer reserves the right to make any changes and to suspend or extend the Promotion.
6) The Organizer reserves the right to disqualify from the Promotion those Participants who, in its sole discretion, are contravening the spirit or the basis of the Promotion, as well as, specifically, those Participants who establish or have attempted to establish systems to speculate, trade or unfairly enrich themselves with the Prize inherent to this Promotion, all without prejudice to any legal actions it deems appropriate to take. 7) The Organizer may automatically remove from the Promotion all those Participants of the Promotion who provide incorrect, inaccurate or false information, as well as any third party in respect of whom there are indications, at the sole discretion of the Organizer, that they have falsified information, attempted to impersonate another third party or acted fraudulently or that they have avoided the application of the rules of the Promotion.

6- PROCESSING OF PERSONAL DATA
The Organizer undertakes to comply with its duty to keep personal data secret, and will adopt the legally provided and necessary measures to prevent its alteration, loss, processing or unauthorized access, taking into account at all times the state of the applicable technology.

7.- APPLICABLE LAW AND JURISDICTION
The interpretation and compliance with these Rules will be governed by Spanish legislation. The Courts and Tribunals of Madrid capital will be competent to hear any disputes that may arise as a result of this Promotion.
